2nd Circuit Tosses FTC Antitrust Complaint Targeting 1-800 Contacts Settlement Agreements

The U.S. Second District Court of Appeals on Friday ordered the Federal Trade Commission to dismiss a complaint against 1-800 Contacts and dismissed the agency's findings that the company had violated federal antitrust laws by consenting to its products not in online searches of its rivals.

The ruling by a unanimous panel of the Manhattan appeals court said the commission "mistakenly concluded that the agreements were an unfair method of competition" and returned the case to the FTC with instructions for clarification.
